Definitions

• "Zetesia", "we", "us", or "our" refers to the owners and operators of the Zetesia Platform.
• "User" refers to any individual or entity that accesses or uses the Platform.
• "Host" refers to a User who lists a hotel, lodge, restaurant, dining venue, or real estate property on Zetesia.
• "Guest" or "Traveller" refers to a User who browses, enquires about, or connects with Hosts through the Platform.
• "Content" includes listings, photos, reels, descriptions, reviews, messages, and any other material uploaded or displayed on the Platform.

About Zetesia

Zetesia is Kenya's hospitality and travel discovery platform. We enable hotels, restaurants, and real estate owners to post their spaces as photos and reels, and we enable travellers and guests to scroll, discover, and connect directly with the people who run those places.

Zetesia provides the platform and tools — it does not act as a party to the transactions or stays that result. Specifically, Zetesia:

• Does not own, operate, or manage any listed property, venue, or experience
• Does not act as a booking agent, broker, or guarantor of any reservation
• Does not control pricing, availability, or service delivery
• Does not process payments between Guests and Hosts

Any booking, enquiry, or engagement is a direct arrangement between the Guest and the Host. Zetesia may provide assistance or moderation in cases of disputed conduct or platform abuse.

User Accounts

Users may register as Guests, Hosts, or both. You agree to:

• Provide accurate information when creating your account
• Maintain the confidentiality of your login credentials
• Accept responsibility for all activity under your account
• Notify Zetesia immediately of any unauthorized access or suspected breach

Zetesia is not liable for losses resulting from compromised accounts caused by user negligence.

Host Responsibilities

Hosts using Zetesia agree to:

• Provide accurate, honest, and up-to-date descriptions of their property or venue
• Ensure photos and reels genuinely represent the space being listed
• Clearly state pricing, availability, and any booking conditions
• Comply with applicable Kenyan laws, including hospitality licensing and health regulations
• Respond to Guest enquiries promptly and professionally
• Honour confirmed arrangements made through the Platform

Zetesia reserves the right to remove listings that are misleading, fraudulent, illegal, or in violation of platform policies.

Guest Responsibilities

Guests using Zetesia agree to:

• Provide accurate information when making enquiries or reservations
• Respect the Host's terms, house rules, and any agreed booking conditions
• Use the Platform for lawful and legitimate purposes only
• Avoid fraudulent, abusive, or harmful conduct toward Hosts or other Users

Guests may submit reviews based on genuine personal experiences. Reviews must be honest, factual, and free from harassment or defamation. Zetesia may remove reviews that violate these Terms or community standards.

Content and Listings

Users retain ownership of Content they submit but grant Zetesia a non-exclusive, worldwide, royalty-free licence to use, display, and distribute such Content for the purposes of operating, promoting, and improving the Platform.

You may not post Content that:

• Is false, misleading, or materially inaccurate
• Infringes any third-party intellectual property rights
• Is illegal, harmful, abusive, or offensive
• Impersonates another person or business

Zetesia may remove any Content at its discretion and without prior notice.

Fees and Subscriptions

Listing on Zetesia is free. Zetesia does not charge transaction commissions on bookings or enquiries made through the Platform. Hosts keep every shilling their Guests pay them directly.

Zetesia may in the future offer optional paid services, including promotional placements or enhanced host tools. Any such fees will be clearly communicated before purchase and are generally non-refundable unless stated otherwise.

Zetesia reserves the right to introduce or modify pricing with reasonable advance notice.

Limitation of Liability

To the fullest extent permitted by law:

• Zetesia is not liable for losses arising from arrangements between Guests and Hosts, including cancellations, no-shows, or service failures
• Zetesia does not guarantee uninterrupted or error-free access to the Platform
• Zetesia is not responsible for the accuracy of third-party Content or the conduct of any User
• Zetesia is not liable for indirect, incidental, or consequential damages of any kind

Intellectual Property

All Zetesia trademarks, logos, platform design, and technology remain the property of Zetesia or its licensors. Users may not copy, distribute, scrape, or exploit platform Content or infrastructure without explicit written permission from Zetesia.

Account Suspension and Termination

Zetesia reserves the right to suspend, restrict, or permanently terminate accounts that:

• Violate any provision of these Terms
• Engage in fraudulent, deceptive, or harmful behaviour toward any User
• Post false or materially misleading listings
• Attempt to circumvent platform security or scrape user data without authorisation
• Threaten the integrity, safety, or reputation of the Platform or its users

Privacy

Your use of Zetesia is also governed by the Zetesia Privacy Policy, which explains how personal data is collected, stored, and used. By using the Platform you acknowledge and accept those practices.

Modifications to These Terms

Zetesia may update these Terms periodically to reflect changes in the Platform, applicable law, or business practices. We will notify users of material changes. Continued use of the Platform after any update constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of the Platform shall be subject to the jurisdiction of the Kenyan courts.
